Text Messaging Terms and Conditions

By providing your mobile number to Frey Law, PLLC (“the Firm”) and opting in to receive text messages, you agree to these Text Messaging Terms and Conditions. These terms govern the Firm’s use of text messages (SMS and, where applicable, MMS) to communicate with you regarding your matter, appointments, scheduling, document requests, billing notifications, account updates, and other service-related communications.

  1. Consent to Text Messaging. You authorize the Firm to send you text messages at the mobile number you provide. Consent to receive text messages is not required as a condition of retaining the Firm. You represent that you are the subscriber for, or customary user of, the mobile number you provide and that you are authorized to consent to receive text messages at that number.
  2. Types of Messages. Text messages may include appointment reminders, requests for information or documents, status updates, billing and payment reminders, and other communications related to legal services. The Firm does not use text messaging for sensitive factual or legal discussions and may direct you to call the office or use another communication method for urgent matters or to discuss questions you may have about your matter.
  3. Message Frequency. Message frequency will vary depending on your matter, your communication preferences, and the activity required to provide legal services.
  4. Opting Out. You may opt out of receiving text messages at any time by replying STOP to any text message. After replying STOP, you will no longer receive text messages except as necessary to confirm your opt-out to the extent permitted by law. Opting out of text messages may affect the speed and convenience of communications regarding your matter.
  5. Help. For help, reply HELP to a text message or contact the Firm directly using its published phone number or email address.
  6. Carrier Charges. Message and data rates may apply. The Firm is not responsible for any charges imposed by your wireless carrier.
  7. Confidentiality and Appropriate Use. Text messaging may be less secure than other communication methods, such as through a telephone call, virtual or in-person meeting, or secure email. Do not send highly sensitive information by text. Text messages may be seen by anyone with access to your phone, mobile account, backups, notifications, or connected devices. If your phone is shared, lost, stolen, reassigned, or your number changes, notify the Firm immediately.
  8. No Guarantee of Immediate Response. The Firm does not guarantee immediate review of or response to text messages. Text messaging is not monitored at all times and should not be used to communicate emergencies, time-sensitive legal deadlines, or urgent requests requiring immediate attention. If your matter is urgent, call the Firm directly or use other instructions previously provided by the Firm.
  9. Accuracy of Contact Information. You agree to provide accurate contact information and to promptly notify the Firm if your mobile number changes or is disconnected. The Firm may rely on the contact information you provide until you notify the Firm otherwise.
  10. Recordkeeping. Text messages related to your matter may or may not be retained by the Firm and included in its client file, subject to the Firm’s document retention practices and applicable law.
  11. Third-Party Service Providers. The Firm may use third-party service providers to facilitate text messaging. Such providers may process your mobile number and related messaging data on the Firm’s behalf, subject to contractual or other legal obligations as applicable.
  12. Changes to These Terms. The Firm may update these Terms and Conditions from time to time. Any updates will become effective when posted to the Firm website or otherwise made available to you, unless a later effective date is stated.

Privacy Policy for Text Messaging

This Privacy Policy explains how Frey Law, PLLC (“the Firm”) collects, uses, discloses, stores, and protects personal information in connection with text messaging communications with clients, prospective clients, and authorized contacts.

  1. Information We Collect. We may collect your name, mobile phone number, matter or account identifiers, communication preferences, message content you send to us, and metadata associated with text messages, such as date, time, delivery status, and message logs. We may also collect information you provide when you opt in to receive text messages or otherwise communicate with us by text.
  2. How We Use Information. We use text messaging information to communicate with you about legal services, scheduling, case or matter administration, document requests, billing notifications, customer service, and to maintain business and legal records. We may also use this information to protect the security of our systems, comply with legal obligations, and enforce our policies and agreements.
  3. Consent and Opt-In. We collect and use your mobile number for text messaging where you provide it to us and consent to receive texts, or where otherwise permitted by law. You may withdraw consent at any time by replying STOP, subject to any limited follow-up needed to confirm your request to the extent permitted by law.
  4. No Sale or Sharing for Marketing. We do not sell your personal information collected for text messaging. We do not share your mobile opt-in data or text messaging consent with third parties for their own marketing purposes.
  5. Disclosure of Information. We may disclose text messaging information to service providers that assist us with messaging delivery, information technology, document management, payment processing, and practice operations; to courts, regulators, insurers, auditors, or law enforcement where required or permitted by law; and to others as necessary to provide legal services, protect rights, or prevent fraud, misuse, or security incidents.
  6. Confidentiality Considerations. Attorney-client communications may be privileged, but text messaging carries inherent privacy and security risks. We encourage clients not to transmit highly sensitive information by text. If you prefer, ask us about alternative communication methods for confidential or substantive legal communications.
  7. Security. We use reasonable administrative, technical, and physical safeguards designed to protect personal information. However, no method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security of text message communications.
  8. Retention. We retain text message information for as long as reasonably necessary for the purposes described in this Policy, including to provide legal services, maintain client files, comply with legal and ethical obligations, resolve disputes, and enforce agreements, after which it may be deleted or anonymized where appropriate.
  9. Your Choices. You may opt out of text messages by replying STOP. You may contact the Firm to update your contact information or communication preferences. Depending on applicable law, you may also have rights to request access to, correction of, or deletion of certain personal information.
  10. Third-Party Platforms and Carriers. Wireless carriers and third-party messaging or device providers may process your communications under their own terms and privacy practices. We are not responsible for the privacy or security practices of these third parties.
  11. Changes to This Privacy Policy. We may update this Privacy Policy from time to time. The updated version will be effective when posted or otherwise made available, unless a later effective date is stated.
